Terms

Who this is between

This is an agreement between NovaLink Solutions Inc, which operates MOLOTOK (“we”), and the business using MOLOTOK (“you”). Signing up for MOLOTOK or using it means accepting these terms.

If you work for that business, or you are one of its clients, this is not your agreement — it is your employer’s, or your contractor’s. What we hold about you is in the privacy notice, which is written for you.

What MOLOTOK is

Software for running a field-service business: clients, quotes, jobs, schedules, timesheets and invoices. We host it for you. Your business has a workspace of its own, with its own database, on servers we run.

It changes. Features are added, and occasionally one is removed or works differently. We will not remove something you depend on without telling you first — before it happens, not in a changelog afterwards.

Trial, fees and renewal

A new workspace starts on a free trial. Its length is shown in your workspace, no card is needed to start it, and nothing is charged during it. When it ends, nothing is deleted and nothing is charged automatically: to keep using MOLOTOK, you subscribe.

A subscription is paid in advance for each billing period, at the price and period shown when you subscribe, plus any tax the law requires us to charge. It renews automatically at the end of each period until you cancel. Payments are taken by Stripe; your card number goes to Stripe and never reaches us. If you and we have agreed a price in writing, that agreement sets the price instead.

If the price changes, we will tell you at least 30 days before the new price applies to you, and it applies from your next billing period after that.

You can cancel at any time, from Settings → Subscription or by contacting us. Cancelling stops the next renewal, and you keep full use of MOLOTOK until the end of the period you have paid for.

Payments are not refundable, including for the rest of a period you cancel part-way through, except where the law says otherwise.

If a payment fails, your workspace says so and you can update your card from it. If it stays unpaid, we may suspend your workspace. A suspended workspace keeps everything: you can still read it all and download it, but nothing can be changed until the account is paid up. Suspending never deletes anything.

Your data is yours

Everything you put into MOLOTOK — your clients, your jobs, your staff’s hours, your invoices — belongs to you. We do not sell it, we do not use it to train anything, and we do not use it to build a product that competes with you.

What we do with it is run the service. That means it sits on our servers and we can technically read it — which is true of anybody who hosts software for somebody else, and is said plainly here and in the privacy notice rather than left for you to work out. We look when you ask us to, or when something is broken and looking is how it gets fixed.

What you are responsible for

MOLOTOK holds information about people who never agreed to anything with us: your clients, and your staff. You decide what goes into it and what it is used for, so the duties that come with that information are yours.

In particular, if you record where staff are when they clock in, telling them is your job, and some states require it in writing. MOLOTOK writes a notice from your own settings that you can adapt and hand out, under Settings → Timekeeping. Using it is neither compulsory nor legal advice.

You are also responsible for who in your business has a sign-in, and for taking it away when somebody leaves.

What you may not do with it

Use it to break the law; put data in it you have no right to hold; try to get into somebody else’s workspace; or resell it as your own. That is the whole list.

What we do and do not promise

We do not promise MOLOTOK will always be available. There is no uptime commitment here, because there is not one we could keep and mean: maintenance, a bad update or an outage at our hosting provider will sometimes take it down.

We back up every workspace every day — its records and its uploaded files — and keep those backups for 90 days, after which each one is deleted. When a workspace is deleted, the backups taken before then still hold it until they expire, at most 90 days later. Backups are how we bring the service back after a failure. They are not a promise that a particular record can be restored on request, and they are no substitute for downloading your own copy.

MOLOTOK is provided as it is and as available. To the extent the law allows, we make no promises about it beyond the ones written in these terms, including any implied promise that it is fit for a particular purpose or of a particular quality.

Limits on what we are liable for. To the extent the law allows, we are not liable for indirect or consequential losses — lost profits, lost revenue or lost business — and our total liability to you for anything arising from MOLOTOK or these terms is limited to the greater of what you paid us in the 12 months before the claim, or US$100. Where the law does not allow a limit like these, it applies only as far as the law does allow.

Ending it

You can stop using MOLOTOK whenever you like. We can end this agreement too, and unless you have done something on the list above, we will give you at least 30 days’ notice and will not do it in a way that strands you mid-job.

Either way, you can have your data. An administrator can download your records from Settings at any time — every table, with photos, uploads and signature images listed but not contained, which the file says on its own first page — and you have at least thirty days from the day you tell us you are leaving before anything is deleted. Your records are never deleted on a timer, so asking late is still asking; only backup copies expire, as the next section says.

The law that applies

The law of the Commonwealth of Pennsylvania, and the state and federal courts sitting there.

Changes to these terms

We will post the new version here with the date it changed. If a change materially affects what you agreed to — what it costs, or what we may do with your data — we will tell you directly, before it takes effect.

To reach us about any of this, use the contact address on your workspace’s Settings → Subscription page.
